These Official Rules (the “Rules”) govern your participation in the EDDISON - Rewind Remix Contest (the “Contest”). Participation in the Contest constitutes your full and unconditional agreement to and acceptance of these Rules, as well as the Physical Radio Giveaway Terms and Conditions, posted at https://www.barbecuerecords.com/giveaway-terms (the “Terms”), so, it is important that you read and understand them. To the extent there is a conflict between these Rules and the Terms, these Rules will govern.

Material Terms. As provided in greater detail in these Rules (and without limiting the express language of these Rules), you acknowledge that: 

• you may not use any third party’s content in your Entry unless you have the express permission of that third party or the content is in the public domain. 

• The Label (as defined below) will own all rights, titles, and interests in and to your Entry.

Sponsors. The Contest is sponsored and run by Physical Radio (the “Station”), headquartered at 56 Scarborough St, Southport, QLD 4215, and Barbecue Records (the “Label”) (together, the “Sponsors”).

​

 

Contest. Details of the Contest are as follows:

 

a.     Products being promoted: EDDISON song entitle “Rewind”

 

b.     Entry Period: begins on August 23rd 2022 and ends on September 30th 2022 at 11:59 pm AEST (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible.

 

c.     Eligibility requirement: entrants must be a real person, at least 18 years old and reside in Australia or New Zealand. Employees of the Sponsors, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

 

d.     How to enter: Those who wish to enter (the “Entrants”) must download the stems of “Rewind” and submit a remix of the song online at https://www.labelradar.com/opportunities/rewindremixcontest/portal (the “Entry”). The entry must fulfil all contest requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsors. You may submit only one mix and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of the Sponsors.

 

e.      Stems. In connection with the Contest and after registering, you may download, reproduce, edit, and create derivative works of the Stems to create an original audio remix of the Stems. To avoid any doubts, the copyright and all other rights, title and interest in and to the Stems and any underlying musical compositions embodied in the Stems provided by Barbecue Records, are owned and controlled by Barbecue Records.

The Stems are provided for the sole purpose of the identified Contest only. No further rights are granted in the Stems or vested in you by the act of downloading the Stems. In other words, you are only allowed to use the Stems for the purpose of the Contest. You are not given permission to upload a track that contains the Stems to a portal (e.g. Spotify, YouTube, SoundCloud etc.).

 

f.      Selection of Winner and Notification: EDDISON, Physical Radio, Aorus and Cooler Master will review the Entries and select one (1) winner (the “Winner") and two (2) runners-up. Entries will be judged based on criteria including, without limitation, creativity, originality and sound.

The Winner will be notified within 7 days of the winner selection. The Sponsors shall have no liability for a Winner's failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 10 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt of the prize offered in this Campaign by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at the Sponsor's sole discretion will result in the Winner's disqualification as winner, and all privileges as winner will be immediately terminated.

In the event that no entries meet the quality standard and requirements required by the Sponsors, at the Sponsor's sole discretion, no winner will be awarded.

The Prizes are to be supplied by the respective Company. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsors. No cash or other prize substitution permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for the Sponsors to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Odds of Winning. The odds of winning depend on the number of eligible entries received.

 

 

Rights Granted by you. By entering this content you understand that the Sponsors, anyone acting on behalf of the Sponsors, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your contest entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image, statements and track submission, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

By entering this content, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of the Sponsors. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Barbecue Records from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Barbecue Records may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Terms. The Sponsors reserve the right, in their sole discretion to cancel, terminate, modify or suspend the Contest should (in their sole discretion) a virus, bugs, non-authorised human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the contest. The Sponsors may revise these Rules at any time in their sole discretion by posting an updated version. Any Rules changes will be effective upon posting, and your continued participation in the Contest after a change to these Rules constitutes your binding acceptance of these Rules.

The Sponsors reserve the right at their sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. The Sponsors have the right, in their sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by contest rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability. By entering you agree to release and hold harmless the Sponsors and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorised human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

Disputes. THIS CONTEST IS GOVERNED BY THE LAWS OF AUSTRALIA AND QUEENSLAND, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this contest, the participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Queensland having jurisdiction. Further, in any such dispute, under no circumstances will the participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this contest), and participant further waives all rights to have damages multiplied or increased.
